PRENUPTIAL AND POSTNUPTIAL AGREEMENTS

Antenuptial (or prenuptial) and postnuptial agreements protect assets for yourself or your beneficiaries. There are many reasons for getting a prenuptial or postnuptial agreement. One reason of course is to protect your assets in the event of a future divorce. Another reason has nothing to do with a divorce, rather it is intended to preserve assets for beneficiaries upon a party’s death. A pre-nuptial agreement is essential for protecting children if a person remarries or is not married to the parent of the children. Under Colorado law, a spouse may inherit the deceased spouse’s entire estate, unless other arrangements have been made by will and by prenuptial agreement.

A prenuptial agreement is prepared and signed prior to marriage. A postnuptial agreement is prepared and signed after parties have already married. Both agreements are like having insurance; you hope you don’t need it, but you’re glad you have it in the even that you do need it.
